Please read each section and tick to confirm. This online version summarises the full Agreement to Mediate; the complete document is available on request and on our website.
We undertake your mediation as members of Resolution and are guided and bound by the Family Mediation Council (FMC) Code of Practice. If you have a concern, raise it with us first; if unresolved, we will provide our complaints procedure and you may refer the matter to Resolution.
You take part by choice. Although you may have been required to attend a MIAM before a court application, the decision to mediate is yours. Either of you may end the mediation at any stage, and we may end it if we consider it inappropriate or unhelpful to continue — in which case we will provide information about your other options.
The mediator manages the process but the choices and decisions remain yours. We are impartial: we do not take sides or advise on your individual best interests. We provide legal and other information on a general, even-handed basis — this is information, not legal advice. If a conflict of interest emerges, we will not continue to act.
Everything discussed is confidential, and settlement discussions are "without prejudice" — they cannot be referred to in court. Exceptions: risk of significant harm to a child or adult; intention to commit an unlawful act; and information released for the purposes of resolving a complaint. Recording of meetings is not permitted unless agreed by everyone in advance. You agree not to call the mediator to give evidence in court, except where the court orders it or the law requires disclosure.
Where finances are involved, you both agree to provide complete and accurate disclosure on an open basis (available to your legal advisers and the court), with a signed statement confirming it. Incomplete disclosure could lead to any agreement being set aside. The Open Financial Summary (OFS) is an open document; the Memorandum of Understanding (MOU) is without prejudice.
We will help you focus on your children's needs, interests and wellbeing. Where children are aged 10 or over, we will offer the opportunity for their voices to be heard through Child-Inclusive Mediation — with both parents' agreement.
The MOU records your proposals so you can each obtain independent legal advice before anything becomes binding. You agree not to seek a binding agreement or court order until you have each had that opportunity. Solicitors usually prepare the formal documents (separation agreement or draft Consent Order).
We process your personal data as part of our contract with you, keep it securely, and do not share it without your permission except as set out in this agreement (see our Privacy Policy). Mediation files are securely destroyed after six years from the conclusion of your mediation. Anonymised data may be retained for research.
All fees are per person, with no hidden charges, payable in advance of each session unless otherwise arranged. MIAM and session charges include any general correspondence, telephone calls and emails. Outcome documents are released once payment is received in full. Most families need 3–5 joint sessions, each allocated 90 minutes. A government voucher of up to £500 is available for eligible mediations involving children — we can apply on your behalf. 48 hours' notice is required to cancel or rearrange; less than 48 hours is non-refundable. Significant additional work will always be costed and agreed with you beforehand.

We will do our best to provide a service you can value. In return, we ask that you each commit to the process: attend sessions as arranged, treat each other with respect, provide information honestly and promptly, and co-operate in looking for workable solutions for your family.
Sign on screen above, or type your name below — either method is accepted. By signing and submitting this form, you confirm that you have read and understood this agreement, have had the opportunity to ask questions, and agree to mediate on these terms. Becky will countersign on receipt. A copy will be emailed to you for your records.
